Freiheit der Information - zwei Jahresgedenktage

Abstract

Da das Jahr 1973 sich dem Ende nähert, ruft es zwei Dokumente von immenser Bedeutung für das Recht auf Informationsfreiheit zugleich ins Gedächtnis: die Allgemeine Erklärung der Menschenrechte (Charta der Vereinten Nationen), deren 25. Jahresgedenktag auf den 10. Dezember- und das Dekret „Inter Mirifica" des Zweiten Vatikanischen Konzils, dessen 10. Jahresgedenktag auf den 4. Dezember fällt. Artikel 19 des ersten und Artikel 5 des zweiten Dokuments enthalten Formulierungen dieses Rechts, die entscheidende Schritte vorwärts in der geschichtlichen Bewegung hin auf seine gesetzliche Verankerung darstellen. Beide Dokumente sind nicht nur durch die Nähe der Daten einander verbunden, sondern auch durch eine wirkliche Affinität ihrer Positionen zum Informationsrecht. (...)

In view of the approaching end of 1973 the author decided to compare two important documents concerning the right of information: the general explanation of human rights (25th anniversary on 10/12/1973) and the decree „Inter Mirifica" of the Second Vaticanum (10th anniversary on 4/12/1973). In the first line the author complains that so far there are still many catholic journalist and editors who are not aware of the importance of paragraph 5 of the „Inter Mirifica" contrary to the later published document „Communio et Progressio". The pastoral instruction was highly noticed and spoken of a!though legally it is subordinate to the former and only relatively important, as the pastoral instruction should only give a number of practical and detailed instructions to realise the principles of „Inter Mirifica".
