Satire – das unbekannte Stilprinzip. Wesen und Grenzen im Journalismus

Das Wesen der Satire wird oft unzureichend gewürdigt: in journalistischen Handbüchern ebenso wie von den Instanzen der deutschen Justiz und des Deutschen Presserates. Eine angemessene Definition bietet die Literaturwissenschaft. Journalistische Satire ist ihr zufolge ein Stilprinzip, das sich äußerlich einer beliebigen Darstellungsform bedient und dessen Wesen in aggressiver Kritik besteht. Satire wendet sich gegen politische oder soziale Missstände, und sie nutzt verzerrende und verfremdende Mittel. Auf der Grundlage dieser Definition ist eine Diskussion der Grenzen von Satire fruchtbar. Was Satire darf, muss im Einzelfall entschieden werden, denn rechtlich und berufsethisch besteht großer Spielraum. Gerichte sind gehalten, mehrdeutige Aussagen im Sinne der Satire auszulegen. Hierzu und um zu entscheiden, welches Werk den besonderen Schutz der Satire genießt, ist ein angemessenes Verständnis der Satire unverzichtbar. Die Spruchpraxis der Gerichte und des Presserates zeigt, dass ein solches Verständnis nicht ohne Weiteres vorausgesetzt werden kann.

The nature of satire is often insufficiently recognized and missed by German courts, the German Press Council and by common journalistic compendiums. Yet, a suitable definition can be found in the field of literary studies. According to this description, satirical journalism is specified as a stylistic principle employed in any journalistic format, whereby the essence of satire consists of aggressive criticism, is directed against political or social grievances and employs alienating and distorting means. On the basis of this definition, a fruitful discussion concerning the boundaries of satire can take place. As the existing legal and ethical framework allows for great tolerance, the freedom of satire must be considered anew with each individual case. Wherever possible, German courts are required to interpret satirical accounts in favor of the satirist. Therefore, and in order to decide whether a specific account enjoys the protection of satire, as afforded by the German Constitution, an adequate understanding of the nature satire is indispensable. According to previous verdicts of the courts and the Press Council, this understanding cannot be simply taken for granted.
